Terms of Use for MedStar Transportation and Medstar Cabulance, Inc.

These Terms of Use ("Terms") govern your use of the transportation services provided by MedStar Transportation and Medstar Cabulance, Inc. ("we," "us," or "our"). By using our services, you agree to these Terms. If you do not agree, you may not use our services.
1. Services
We provide non-emergency medical transportation (NEMT), paratransit, fixed-route, VA, Medicaid, and other transit services throughout the Pacific Northwest, including Washington, Oregon, Idaho, Montana, Utah, and California. Services may be accessed via phone, website, mobile app, or third-party integrations, such as GOIN.org.
2. Eligibility
You must be at least 18 years old to book services, or a legal guardian/caretaker must book on behalf of minors or dependents.
By using our services, you consent to notifications via SMS, email, automated calls, or app notifications as part of service functionality.
You agree to provide accurate and complete information during booking.
3. Booking and Cancellation
No-Show and Late Cancellation Policy: Riders who fail to cancel rides within the required time frame or who fail to show up for scheduled rides may incur fees. Excessive no-shows may result in suspension or termination of service.
Service Refusal: We reserve the right to refuse service in cases of abuse, repeated no-shows, or disruptive behavior.
4. Pricing and Payment
Payments may be billed directly to payors (e.g., insurance companies, Medicaid) or paid by the rider as applicable.
Additional fees may apply for late cancellations, no-shows, or services not covered by payors.
Refunds, if applicable, will be handled on a case-by-case basis.
5. User Conduct
To ensure safety and quality, riders must adhere to the following rules:
Safety Requirements: Riders must wear seat belts during transit, follow driver instructions, and use mobility devices or transportation aids as required for their safety.
Prohibited Behavior: Disruptive, abusive, or unsafe behavior is not allowed. This includes harassment, physical or verbal abuse of staff or other passengers, and any conduct that jeopardizes safety.
Violations may result in immediate suspension or termination of service.
6. Liability
We are not liable for delays, missed appointments, or accidents caused by factors beyond our control, including traffic, weather, or third-party subcontractor issues.
Riders are responsible for ensuring accurate booking information to avoid service disruptions.
7. Intellectual Property
All content on our website, mobile app, and service-related materials, including text, graphics, and logos, is our property. You may not copy, modify, or distribute this content without written consent.
8. Privacy
By using our services, you agree to our Privacy Policy (link). We are committed to protecting your personal information in compliance with applicable laws.
9. Termination of Service
We reserve the right to terminate or suspend your access to services for:
Violations of these Terms.
Misuse or fraudulent behavior.
Excessive no-shows or disruptive conduct.
10. Dispute Resolution
All disputes must be resolved through mediation before pursuing further legal action.
Mediation will occur in Yakima, WA or Everett, WA and will be governed by the laws of the State of Washington.
By agreeing to these Terms, you waive the right to participate in class-action lawsuits against us.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Updates will be communicated via email to the address on file and posted on our website. Continued use of our services constitutes acceptance of the updated Terms.
